On the Grow Series “You’re a Star Baby” Contest Rules

No Purchase Necessary
The On the Grow Series “You’re A Star Baby” Contest is sponsored by Syllable Publishing, a division of RPS Holdings, Inc. (“Syllable Publishing”). No purchase or payment is necessary to enter this contest. Syllable Publishing reserves the right to modify the rules of this contest in any way or at any time, without prior notice. Syllable Publishing also reserves the right to cancel this contest at any time, without prior notice.

How to Enter
NO PURCHASE NECESSARY. The contest begins on October 15, 2008 at 10:00 a.m. CDT and ends on January 15, 2009 at 11:59 p.m. CST (the “Entry Period”). In order to enter this contest, submit (1) up to three clear and accurate color photographs (no smaller than 4x6 inches and no larger than 8x10 inches) of your child when he or she was age 0-8 and engaged in an age appropriate activity, and (2) your name, address, daytime telephone number and valid e-mail address, to Syllable Publishing. Entries must be mailed to Syllable Publishing, 935 Blue Gentian Road, Eagan MN 55121. Entries must be received within the Entry Period. Syllable Publishing does not assume responsibility for lost, illegible, incomplete, unconfirmed, damaged, late or misdirected entries, all of which will be void. Entries become the property of Syllable Publishing and will not be acknowledged or returned. Proof of submission is not proof of receipt by Syllable Publishing. Limit one entry per child per household. No group entries. Syllable Publishing reserves the right, in its sole discretion, to reject, disqualify, modify, edit, and revise any entries, subjects, photos, or related materials that are nude, obscene, defamatory, profane, offensive, lewd, pornographic, false, misleading, deceptive, or otherwise inconsistent with its editorial standards, audience expectations, or reputational interests or that Syllable Publishing believes may violate any applicable law or regulation or the rights of any third party. Syllable Publishing reserves the right, in its sole discretion, to verify any element of any entry or related materials and to disqualify any entrant whose participation may subject the contest, Syllable Publishing, or Syllable Publishing’s advertisers, clients, or customers to controversy, negative publicity, scorn, or ridicule.

Eligibility
Legal residents of the 50 United States, and the District of Columbia, 21 years of age or older at the time of the entry who are the parent or legal guardian of the child depicted in the photograph(s) submitted are eligible to enter, except employees of Syllable Publishing and their immediate family. Photos must have been taken by entrant or another non-professional and must be unpublished. Photos must not contain material that violates or infringes the rights of another, including but not limited to privacy, publicity or intellectual property rights, or that constitutes copyright infringement. The contest is subject to all applicable federal, state and local laws and regulations. This contest is void where prohibited or restricted. Any person attempting to defraud or in any way tamper with contest results will be ineligible for any prizes and may be prosecuted to the full extent of the law.

Selection of Winners
There will be twenty (20) winners selected from among all eligible entries by judges appointed by Syllable Publishing. Winners will be selected based on the following weighted criteria: overall appearance of the child as shown in the photo(s) (34%), adherence to the requirement that the child be engaged in an age appropriate activity (33%), and quality of photo(s) (33%). Syllable Publishing reserves the right to select fewer than twenty (20) winners if, in its sole discretion, it does not receive a sufficient number of eligible and qualified entries to select twenty (20) winners. Judges will select the winners on or about January 30, 2009. The decisions of the contest judges will be final and binding on all matters including the validity of entries, and the determination of the potential winners shall be final. The potential winners will be notified by email and/or phone within five (5) days of the judges’ determination. Odds of winning the “You’re a Star Baby” contest depend on the number of eligible entries received. ATTEMPTS WILL BE MADE TO NOTIFY THE POTENTIAL WINNERS BY PHONE AND/OR E-MAIL FOLLOWING THE CONCLUSION OF THE CONTEST ON OR ABOUT JANUARY 30, 2007. Syllable Publishing reserves the right to request additional information from entrants. The potential winners will be required to execute and return an affidavit/declaration of eligibility and a liability release within 10 days and, except where prohibited by law, a publicity release within the timeframe specified by Syllable Publishing or the prize will be forfeited and an alternate winner will be selected from all eligible entries received, time permitting. By entering, you agree that if the selected entrant is disqualified and the prize is forfeited for any reason, Syllable Publishing shall be fully and completely released and discharged from any liability or responsibility in this regard. Winning photographs will be posted on www.onthegrowbooks.com no later than February 15, 2009.

Prize
A picture depicting the likeness of each winner’s child will appear in a future On the Grow Series book. The value of the prize is estimated at $150. The prize is nontransferable. No prize substitution or cash equivalent allowed. Likeness of each winner’s child as it appears in an On the Grow Series book may not be an exact replica, but rather a representation of each child’s likeness as interpreted by the author and illustrator of the book. All federal, state and local taxes are the sole responsibility of the winner. Except where legally prohibited, acceptance of the prize constitutes permission for Syllable Publishing to use their name, likeness, biographical data, city and state of residence as well as the first name, likeness, biographical data, city and state or their child and entry materials in children’s books, promotional material and for advertising, public relations and editorial purposes worldwide, in perpetuity, or on a winner’s list, if applicable, without further compensation unless prohibited by law. Syllable Publishing is not obligated to use any of the above-mentioned information or materials, but may do so and may edit such information or materials, at Syllable Publishing’s sole discretion, without further obligation or compensation. The awarding of any prize is contingent upon full compliance with these Official Rules. Entrants agree to be bound by these rules and agree that if any winner fails to provide proof of identity, refuses to provide required affidavit, is found to have violated these rules or otherwise does not meet eligibility criteria, prize will be forfeited and awarded to an alternate winner with the next highest score. Entrants understand that Syllable Publishing is not liable for injuries, losses or damages of any kind arising from participation in this promotion and acceptance, possession and use of prize. Syllable Publishing is not responsible for any typographical or other error in the printing of the offer, administration of the contest or in the announcement of the prize. Decisions of Syllable Publishing are final and binding in all respects.

By entering and providing the required entry information, you acknowledge that Syllable Publishing may also send you information or special offers it believes may be of interest to you about its publications or other services offered by Syllable Publishing. Information collected from online entrants is subject to Syllable Publishing’s privacy policy at www.onthegrowbooks.com. Limitation of Liability
By participating, entrants agree that Syllable Publishing, those involved in the development, production (including prize suppliers), implementation and distribution of this promotion and their respective parent companies, affiliates, subsidiaries, service providers, and agencies, and their directors, officers, agents, employees, attorneys, and any other person or entity associated with such entities and/or promotion shall not be liable for any and all claims, damages, losses or injuries, including any third party claims, arising from or relating to, in whole or in part, this contest, including entry and participation in this contest and acceptance, possession, use or misuse of any prize, or participation in prize-related activities. Syllable Publishing shall not be responsible for any technical malfunctions of the telephone network, computer on-line system, computer equipment, software, program malfunctions or other failures, delayed computer transactions or network connections that are human, mechanical or technical in nature, or any combination thereof, including any injury or damage to entrant’s or any other person’s computer related to or resulting from downloading material and/or participating in any part of this contest. In the event of any third party claims, damages, losses or injuries, arising from or relating to this contest, entrants will indemnify Syllable Publishing from any and all such claims, including the attorney fees related thereto.

Governing Law
Unless specifically prohibited by law in the entrant’s jurisdiction of residence, this contest shall be governed by Minnesota law. By participating in this contest, entrants agree that Minnesota courts shall have jurisdiction over any dispute or litigation arising from or relating to this sweepstakes and that venue for any such disputes shall be only in Minneapolis, Minnesota.

The winners’ names will be posted on www.onthegrowbooks.com within thirty (30) days of the winner’s selection.
